Rules of Participation and Legal Aspects of the XX Edition of the Talgo Award for Technological Innovation

The following rules govern the call for entries and participation in the XX Edition of the Talgo Award for Technological Innovation. The purpose of this Award is to promote and develop innovation projects that give additional value to railway technology and mobility, and which are organised by PATENTES TALGO, S.L.U., with registered office in Las Matas, Paseo del Tren TALGO nº 2, Las Rozas, Madrid with N.I.F. (Tax Identification Number) number B-84528553 (hereinafter TALGO or the ORGANISER). Participation in the Award implies full acceptance of these rules.

This edition of the Talgo Awards for Technological Innovation will be divided into two categories as set out below:

CATEGORY I

⇒ RAILWAY TECHNOLOGY AWARD. In this category, projects that involve a technological advance, whose application in railway operation will lead to significant improvements, will be assessed.

CATEGORY II

⇒ MOBILITY AWARD. In this category, projects in a more global setting, such as transportation, will be recognised. Projects related to Industry 4.0, Big Data, security, accessibility, intermodality, circular economy, sustainability, digital transformation, user experience, passenger services, last mile services and cybersecurity will be assessed.

Each of the two awards in this edition will be endowed with:

Fifteen thousand euros (€15,000.00), for the person or group of people whose project wins. In the event that the award is given to a group of people, the ORGANISER will distribute the award equally among the group with the winning project.

⇒ A commemorative sculpture.

Likewise, the author or authors of those works that the Jury considers worthy of a mention of quality, may publish their project in a prestigious magazine related to the railway sector and mobility, with the expenses of such publication to be paid by the ORGANIZER.

The Awards are open to natural persons of legal age (as individuals or as a group) or legal entities that submit works or projects in accordance with the provisions of these Rules. There is no limit to the number of projects submitted per natural or legal person or group of people. The same person can submit projects in both categories and win in both categories. Proposals may be submitted by both people belonging to the Spanish national territory and of an international nature.

The call for applications will be open and exclusively from February 1, 2023 at 9:00 a.m. until June 1, 2023 at 11:59 p.m.

To take part in either of the two categories, please complete the form available on the website (www.premiotalgoinnovacion.com). The projects and works must be submitted in digital format and should preferably be written in Spanish; alternatively, they may be presented in English.

SELECTION COMMITTEE

The Selection Committee chosen by TALGO will analyse and evaluate the projects submitted by the participants within the deadline and will choose those which, according to the criteria described below, are to be considered as potential winners.

If the Selection Committee considers it necessary, it will request and summon the participants worthy of being finalists for a public defence of their proposal and/or expansion of the information presented. Refusal to participate in this public defence or failure to attend will mean that the participant will not be able to continue taking part in this edition of the awards.

OFFICIAL JURY

An Official Jury made up of prestigious personalities will choose, from among the works and projects previously selected by the Selection Committee, those which, according to the criteria described below, are worthy of winning. The decision of the Official Jury shall be final.

TALGO reserves the right to declare the call totally or partially void in the event that it considers that none of the projects presented satisfies or fulfils the criteria formulated.

The Jury will value positively the following criteria in both categories, although they are not obligatory:

⇒ INNOVATION. Use of new technologies, novelties or modification of elements that lend added value not previously obtained.

⇒ IMPACT. Potential of the project with regard to the proposed objective or related objectives.

⇒ RELATIONSHIP WITH RAILWAY TECHNOLOGY. In both categories, the link of the proposal to railway technology and with TALGO technology in particular will be positively assessed.

In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, as well as with the applicable national regulations on data protection, Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, you are hereby informed of the basic components of the processing of your personal data:

Responsible for Processing:

Purpose of Processing:

a) your participation in this and subsequent editions of the Talgo Technological Innovation Awards, as well as to inform you of the call for entries of the awards,

b) the management and delivery of the awards in the event that you are the winner,

c) the dissemination of the presentation of the awards in the event that your project is chosen as a winner or finalist, and

d) any dissemination or promotional activity of the award both during this edition and in future editions.

Legitimation:

The consent of the interested party to participate as an applicant for the Award, as well as the fiscal and tax regulations applicable to it.

Type of data:

Name and Surname, ID card or equivalent identity document, contact telephone number, contact e-mail, academic degree, University where he/she has studied, Department to which he/she belongs, position, time in current position, years of seniority in the Company / Organization, awards obtained in the scope of the Award, or in any other, image.

Data recipients:

PATENTES TALGO S.L.U. and affiliated companies of this one, within the purpose described above, for the correct management of the Award.

International transfers:

No.

Conservation period:

For the duration of the processing of the Awards and, once it has been completed, the interested party authorizes Talgo to keep his/her data indefinitely for the sole purpose of being included in its Annual Reports and corporate publications, limited to his/her image and name and surname. In addition, in application of Law 10/2010 on the prevention of money laundering and terrorist financing, your data will be retained by law for a period of 10 years, exclusively for the purposes of these regulations.

Rights of the Person Concerned:

⇒ Access to data: obtain confirmation of whether or not the data is being processed.

⇒ Amendment: to obtain without undue delay the amendment of inaccurate personal data.

⇒ Cancellation: to obtain without undue delay the erasure of personal data.

⇒ Limiting the processing of your data: limit the processing operations that would correspond in each case, although the data will continue to be stored in the files intended for this purpose.

⇒ Opposition to processing: to object to the use of any personal data for a specific purpose, without prejudice to those that are essential for the purpose.

⇒ Claim before the AEPD (Spanish Data Protection Agency), in the event that your requests are not met.

How to exercise your rights:

You may exercise your rights of access, amendment, deletion, limitation of processing, data transferability and objection before the person responsible for the processing by sending your request in writing with the subject “Personal Data” to TALGO or by sending an email with the same subject to premiotalgo@talgo.com specifying which right you wish to exercise.

Response time:

We will respond to requests within a maximum of one month from receipt of the request. This period may be extended by a further two months, if necessary, depending on the complexity and number of requests. The person in charge will inform the person concerned of the extension within one month of the request.

LEGAL ASPECTS, INTELLECTUAL AND INDUSTRIAL PROPERTY, FORM OF PAYMENT AND CONDITIONS OF PARTICIPATION:

The presentation of these Awards does not involve any commitment for TALGO in relation to the application, development or implementation of the winning project/work. However, and in relation to the selected finalist projects, TALGO may offer the creator(s) the possibility for TALGO to pay for the expenses of the implementation and Presentation of the corresponding Patent. In any case, the creator(s) will make the final decision. In the event of opting for such collaboration, TALGO would be the owner of the patent and its rights in the terms agreed between the parties, with the authorship of such Patent by TALGO being recognised at all times. Therefore, the rights over the projects, unless otherwise agreed, will belong to the participants.

Participation implies acceptance of these Rules, and is expressly subject to the promoters’ interpretations of them. The promoters reserve the right to change, suspend or cancel the execution of the Awards based on what is necessary. The interpretation and fulfilment of the Rules will be governed by Spanish law. The Courts and Tribunals of the city of Madrid shall be appointed to hear any disputes that may arise as a result of this Promotion.

The awards will be paid by TALGO to a representative of each of the winning projects by bank transfer to the account expressly designated by the winners.

In the event that any of the awards goes to a public administration, entity, body or organisation (with the exception of Universities) the winning entity will have a period of one month to choose an Association or Foundation (public or private, and outside a political party), to which to donate the full amount of the award, with the aim of promoting research in any of its fields.

Once chosen, it must be communicated to TALGO for approval. From then on, the winner will have another week to make the transfer to the beneficiary organisation, which will have to issue a donation receipt to the winner. The winner must send both the donation receipt and the transfer receipt to TALGO.

The delivery of the awards will be carried out within two months from the moment of their delivery, unless the winner has not provided TALGO with the payment details, in which case TALGO is not obliged to make any payment until it has been clearly informed of where to proceed with the payment.

No member of TALGO’s staff or of its Foundation will be allowed to compete for the XX Edition of the TALGO Technological Innovation Awards. The members of the Selection Committee and the members of the Official Judges Panel, as well as their relatives, are not allowed to compete either.

A maximum of three calls is established to present a project. Those works that exceed this number will not be considered by the Selection Committee to be eligible for the award in any of its categories.
